Terms of Service

1. Who We Are & Acceptance

The Service is provided by Arkmusic (business name), a sole proprietorship registered in the Republic of Korea, operating the “Nestages” service. You can reach us at support@nestages.com.

By accessing or using Nestages, you agree to be bound by these Terms of Service and by our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Service. The Service is not directed to children.

If you use the Service on behalf of a business or organization, you represent that you are authorized to bind that entity to these Terms.

3. The Service

Based on photos of interior spaces you upload, Nestages uses artificial intelligence to generate virtual interior images (virtual staging, redesign, and furniture removal) and to generate property-listing copy such as listing descriptions, Instagram captions, and short-term-rental descriptions.

All results are generated automatically by AI. They are illustrative only and do not guarantee the actual condition, dimensions, materials, code compliance, or buildability of any real space. They are not architectural plans and must not be relied upon for construction, valuation, or permitting.

4. Accounts

You can sign in with a passwordless email “magic link”. You are responsible for maintaining the security of the email account associated with your Nestages account and for all activity that occurs under your account.

You agree to provide accurate information and to keep it up to date.

5. Free Use, Credits, Plans & Billing

Free use: Signed-out visitors may use the Service within a free-trial allowance and daily usage limits. Images generated on the free tier include a Nestages watermark.

Credits: Image generation consumes credits. One credit is deducted per generated image variant. If a generation fails, the credit for that variant is automatically refunded to your balance.

Subscriptions & auto-renewal: Paid plans are subscriptions that automatically renew for successive periods (e.g., monthly) at the then-current price until you cancel. YOUR SUBSCRIPTION WILL CONTINUE AND RENEW, AND YOUR PAYMENT METHOD WILL BE CHARGED ON A RECURRING BASIS, UNTIL YOU CANCEL. You may cancel at any time from your account or billing-management flow; cancellation takes effect at the end of the current billing period, and you retain access until then. Credits do not roll over between billing periods unless stated otherwise.

Payment processor (Merchant of Record): Payments are processed by Lemon Squeezy, which acts as the Merchant of Record and reseller for your purchase. Your purchase is therefore also subject to Lemon Squeezy’s terms and refund handling. We do not receive or store your full card details.

Refund policy: Except where a longer right applies by law, an initial subscription purchase may be refunded only if you request it within 7 days of the charge, have used fewer than 10 generations in that period, and have not previously used this refund right. Credits already used are non-refundable and renewals are not pro-rated, except where required by law. If you are a consumer in the EU/EEA or the United Kingdom, you may have a statutory 14-day right of withdrawal; by starting to use the Service during that period you may lose that right to the extent of the services already supplied. Refund requests: support@nestages.com.

Refund effect on credits: If a payment is refunded or charged back, the credits granted for that payment are revoked. If already-spent credits are included in the revocation, your balance may show a negative number, which is offset against future top-ups.

6. Your Content & License to Us

You retain all rights you hold in the photos and text you upload (“Your Content”). You must only upload content you own or are authorized to use, and you must have the rights and any necessary consents for any person or property depicted.

To operate the Service, you grant Arkmusic a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, modify, transform, transmit, and display Your Content — including transmitting it to our AI provider (Google) to generate results — solely to provide, secure, and support the Service. We do not use your private uploaded photos or private generated results to train public third-party foundation models.

7. Generated Images & Copy (Output)

Subject to your compliance with these Terms and payment of applicable fees, you own the images and copy generated for you (“Output”) and may use them for personal or commercial purposes, including real-estate and rental marketing.

Because Output is generated by AI, similar or identical Output may be generated for other users, and Output may be inaccurate or contain artifacts. You may not (a) represent that Output was created by a human or is an unaltered photograph, or (b) use Output to develop or train a competing AI model.

8. Virtual-Staging Disclosure (Important)

Virtual staging, redesign, and furniture-removal images are digitally altered and AI-generated. If you use them in property or rental advertising, you are responsible for disclosing that the images are virtually staged or digitally enhanced, and for complying with the rules of your jurisdiction, MLS, and platform (for example, MLS and real-estate advertising rules that require disclosure of virtually staged or AI-generated images). You must not remove or obscure any AI/virtual-staging label or metadata we apply.

9. Acceptable Use

You agree not to: upload content that infringes or violates the rights of others; use the Service to deceive or to misrepresent the actual condition of a property; upload unlawful, harmful, or offensive content; circumvent usage limits, watermarks, or technical protections; or use automated means to place high-volume or abusive requests.

10. Intellectual Property

The Service itself — including the Nestages name, software, design, and content we provide — is owned by Arkmusic and protected by law. These Terms do not grant you any right in our brand or software except the right to use the Service as permitted here.

11. Copyright & DMCA Takedowns

We respect intellectual-property rights and respond to notices of alleged infringement. If you believe content on the Service infringes your copyright, send a notice with the information required by 17 U.S.C. § 512(c)(3) to our designated agent: Arkmusic, Attn: Copyright Agent, 369 Jijok-ro, Yuseong-gu, Daejeon, Republic of Korea — legal@nestages.com.

We may remove infringing content and will terminate, in appropriate circumstances, the accounts of repeat infringers.

12. Third-Party Services

The Service relies on third-party providers, including Google (AI generation), Supabase (database, authentication, and storage), and Lemon Squeezy (payment / Merchant of Record). Your use may be subject to those providers’ terms, and we are not responsible for their services.

13. Disclaimers

THE SERVICE AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY AS TO THE ACCURACY OR RELIABILITY OF AI-GENERATED RESULTS. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARKMUSIC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100.

Nothing in these Terms limits liability that cannot be limited under applicable law, and nothing limits the statutory rights of consumers.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Arkmusic from claims, damages, and reasonable costs (including legal fees) arising out of Your Content, your use of Output, your use of the Service, or your breach of these Terms or of any law or third-party right — including any failure to make required virtual-staging disclosures.

16. Suspension & Termination

We may suspend or terminate your access if you violate these Terms or use the Service in a way that may cause harm or legal risk. You may stop using the Service at any time. On termination, your right to use the Service ends; provisions that by their nature should survive (such as license grants, disclaimers, liability limits, and indemnities) will survive.

17. Changes to the Service or Terms

We may modify or discontinue features of the Service, including where necessary due to maintenance or changes by third-party providers. We may update these Terms; if we make material changes we will take reasonable steps to notify you. Your continued use after changes take effect means you accept the updated Terms.

18. Governing Law & Disputes

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-laws rules, and disputes will be subject to the courts of the Republic of Korea.

If you are a consumer, this choice of law and forum does not deprive you of the protection of the mandatory consumer-protection provisions of the law of your country of residence, and you may also be entitled to bring proceedings in your local courts.

19. General

If any provision is found unenforceable, the rest remains in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the business. Our failure to enforce a provision is not a waiver.

Effective Date

These Terms take effect on July 12, 2026.
